FDA PUBLISHES ANPRM ON LIMITING NICOTINE IN CIGARETTES
Yesterday, the FDA published its Advanced Notice of Proposed Rulemaking (ANPRM) entitled “Tobacco Product Standard for Nicotine Level of Combusted Cigarettes.” The ANPRM addresses whether to implement a product standard for establishing a lower level of nicotine in combustible cigarettes. An ANPRM is the earliest step that can be taken in a regulatory
rulemaking process. The ANPRM does not proffer a proposed regulation. Rather, it asks for comments on a series of questions that the FDA will consider in evaluatingwhether to draft a regulation and, if so, what it should look like. After reviewing all the comments, FDA then prepares and publishes its Notice of Proposed Rulemaking (NPRM) which will then be submitted to another notice-and–comment period. Given the complexities of what is being requested, this process can take quite some time.

While this ANPRM does not directly affect the vapor industry, the FDA, in previous statements, has underlined that a key component of this proposed policy is the availability of lower-risk forms of nicotine delivery, such as vaping products
Flavors. Of note, however, in announcing this ANPRM, the Commissioner makes reference to another ANPRM on flavors which will be forthcoming. He says, “the FDA also plans shortly to issue two additional ANPRMs: one to seek comment on the role that flavors – including menthol – play in initiation, use and cessation of tobacco products.” This is not a surprise, as it is what FDA first announced last July. In anticipation of this ANPRM, VTA already is preparing its response. If your company is interested in participating in a full-throated defense of flavors, please let us know now.

First, I don’t write fan letters. Having said that, I wanted you to understand my
situation. Next week, I turn 62. I smoked for 40 years. 6 months ago, as a
promise to my 16 year old, I put cigarettes down and started vaping. After trying
numerous other methods to stop over the years, for some reason vaping took hold
immediately. From the first day I tried vaping, I havent looked back.
Vaping became a hobby for me. I’ve tried numerous mods, tanks – you know the
drill. But after all the ‘playing’ I’m finding myself (finally) settling in.
I’ve purchased 2 zenith tanks, and I’m hoping my Ares will arrive before Friday
3/16 as my birthday prrsent to myself. And I’m equally confident, once I’ve
gotten familiar with it, I’ll be ordering a second Ares. The world of 12-25
watts is my domain!
Anyway, just wanted to say thanks. I appreciate your videos and your efforts
on behalf of vaping. I am a fan, and will continue to be so. Keep up the good

This will not take you long to do. Please be involved, take action, and SHARE!!
Budget negotiations are happening right now and we only have a short time to make an impression. This is the time to reach out to Congress and urge them to support us.
By March 22nd, Congress will need to come up with a plan to fund a massive two-year spending package. Right now, we have an opportunity to urge support for predicate date change language in the appropriations side of the 2018 budget that will keep vapor products on the market beyond FDA’s prohibition date of 2022.
At the same time, those of you who live in districts represented by a co-sponsor of the stand-alone version of the predicate date change (HR 1136) will be sending a thank you message. As much as some in Congress need encouragement to support us, those who are already on our side need to hear that we support them.
Help us show Congress that we are unified in our support for changing the predicate date to August 8th, 2016 and that we are in favor of reasonable regulation that protects young people and preserves consumer choice.
