It’s the only reason why the U.S. vaping industry is alive and growing today: FDA’s extension of compliance deadlines—related to the Final Deeming Rule—to 2022. It’s allowed the vaping industry to stay open. And without it, nearly every single vapor device and e-juice would be off-the-market.

But, the extension is not permanent and may be vulnerable to legal challenge. A coalition of public health NGO’s is currently seeking the federal district court of Maryland to vacate the August 2017 Guidance Document, which issued the extension. If they win, it will be lights out for vaping.

In this episode of RegWatch, top vaping lawyer Azim Chowdhury walks through the arguments made against vaping, the industry’s robust response and how FDA winds up being a surprising ally, as it protects its authority to issue Guidance and extend deadlines.

So we already know that not being permitted to advertise vaping as far safer than smoking by the FDA is forcing the industry to lie to consumers.

Are we being forced to do that again with this warning label?

I ask because I found some interesting information on-line…

Pure nicotine
Nicotine isn’t dependence-forming at all, outside of tobacco use. It has been found clinically impossible to show any dependence potential for pure nicotine.

None of the many clinical trials in which large quantities of pure nicotine were administered daily to never-smokers – the equivalent amount to that contained in up to 18 cigarettes, for up to 6 months – ever found any subject who showed any sign of dependence.

The leading researcher in this field, Dr Newhouse, whose day job is administering large amounts of pure nicotine to never-consumers of tobacco, says: “The dependence potential of pure nicotine is virtually nil”.

Because pure nicotine is not dependence-forming, it cannot be addictive either. In modern use, dependence means a compulsion that may be harmless or close to it, and addiction is compulsion plus clear and inarguable harm.

RegWatch reports today that the extraordinary and unprecedented flood of fake comments into the network hosting the public consultation process for FDA’s proposed Regulation of Flavors in Tobacco Products is much higher than previously known.

With the comment period now closed, staff at Regulations.gov have confirmed to RegWatch that 95% of the 525,000 comments received into the system are indeed BOT submitted comments or are otherwise duplicate in nature. It’s a stunning revelation.

Another well written article and a good read by my BFF who continues to impress me…

The debate around how to prevent underage youth from accessing vape products is an important one. Our organization strongly supports enforcement efforts to crackdown on illegal sales and punish bad actors. Vape products are for adult smokers— period.

But we must also preserve the consumer choice that people like me have relied on to quit smoking for good. It is a false dichotomy to claim we can’t have both.

A PBusardo Review – The Taifun Box + Last “Not A” Contest Winner and a New One!

Hi Phil,

I was looking at your success story page and saw my email to you in June of 2013 and
realized 5 years have passed. On my 5 year vapeversary I wanted to check in with you
and say thank you again because without you I would still be smoking. When I started
to look into vaping all those years ago, endless web searches left me more confused,
until a link to one of your videos came up. I was hooked by your level of detail,
insights and humor. From there I found your site which guided me to buy my first
ecig and juice. I continued to enjoy your videos and content as I advanced to better
gear. Bottom line is without you I would still be smoking a pack and a half a day of
Parliments. What you do, the body of work you created saves lives and it is
something you should never forget. How many people have you helped kick the habit?
How many people can say the saved even one life and yet you have impacted
thousands.

I was so motivated by what I learned from you I started my own review channel called
VarosVapor and joined the guys from Inside Vaping for a while, making some great
friends in the community and joining the fight for advocacy. Anyone I may have
helped is because of me being inspired by you. That’s all done now, haven’t made a
review in years and I am just an ex-smoker who vapes, has not had bronchitis in 5
years and feels great, never wanting to touch another cigarette.

Thank you Phil, from me and my family who may have me around a little longer, thank
you for your hard work and dedication.

Rules around e-cigarettes should be relaxed so they can be more widely used and accepted in society, says a report by MPs.

Vaping is much less harmful than normal cigarettes and e-cigarettes should be made available on prescription to help more people quit smoking, it said.

The report also asks the government to consider their use on buses and trains.

There is no evidence e-cigarettes are a gateway into smoking for young people, Public Health England said.

The report on e-cigarettes, by the science and technology MPs’ committee, said they were too often overlooked by the NHS as a tool to help people stop smoking.
