CATCHING UP WITH REGULATOR WATCH: “Surprise Switcheroo” | Industry Legal Challenge to FDA Denial Orders

From Brent Stafford at Regulator Watch

The fight to save vaping in the United States appeared almost over when FDA issued Marketing Denial Orders to over 300 vaping product manufacturers, thus requiring more than 5-million vaping products to be taken off the market.

But dozens of vape companies fought back, launching legal action against FDA.
Today on RegWatch, hear from Eric Heyer, partner at the law firm Thompson Hine and litigator behind many of the court challenges on behalf of major U.S. vape manufacturers. Learn why several vape companies have been granted judicial stays on their Marketing Denial Orders, which means these producers can continue to sell their vape products while lawsuits remain active.

Could the industry stave off disaster? Find out.

CATCHING UP WITH REGULATOR WATCH: Case Crumbles | Losing Logic Behind Flavour Bans

From Brent Stafford at Regulator Watch

Health Canada’s case for a ban on flavours in nicotine vaping products appears to be crumbling as evidence mounts regarding its potentially disastrous impact on public health.

According to a new report, “The Case for Flavours,” by prominent tobacco harm reduction researcher Dr. Konstantinos Farsalinos, flavour bans effectively equate to a form of prohibition, which would fuel the growth of a massive black market and spur a deadly rise in cigarette smoking.
In this episode of RegWatch, hear Dr. Farsalinos discuss his multidimensional review of the use of flavours in nicotine vapes and learn what he recommends regulators should do instead of banning flavours.

CATCHING UP WITH REGULATOR WATCH: Strict Reading | Could China’s E-Cig Regs Upend Global Open System Supply?

From Brent Stafford at Regulator Watch

Late last year, China amended its laws, so that vaping product manufacturers are now subject to strict regulation by the Chinese government, under the same regulatory authority as combustible cigarettes.

The move outlaws the production and sale of refillable vapes for the domestic market, causing genuine concern over the future global supply of open systems hardware.
In this episode of RegWatch, we are joined by esteemed regulatory lawyers Azim Chowdhury in Washington, D.C., and David Ettinger in Shanghai, China, both from the firm Keller & Heckman.

Could China’s new regs threaten vaping across the globe? Find out!

THE CDC’S DECEPTIVE YOUTH VAPING FIGURES

“According to the latest results from the National Youth Tobacco Survey (NYTS), the CDC says, “about 2.55 million U.S. middle and high school students reported current (past 30-day) use of a tobacco product in 2021.” If you have not been paying attention to the CDC’s inveterate dishonesty on this subject, it may surprise you to learn that most of those 2.55 million students did not use products that contained tobacco. The CDC routinely conflates e-cigarettes with “tobacco products,” despite the vast difference between the risks posed by vaping nicotine and the risks posed by inhaling smoke from conventional cigarettes. The press release notes that “about 1 in 3” of those 2.55 million students “used at least one type of combustible tobacco product,” which means two-thirds did not. Smoking among teenagers has been falling since the late 1990s, and that downward trend accelerated as vaping took off.”

FRANCE – Doctors Call For Gov’t Support Of Vaping

“16 French doctors, researchers and medical professors have called for government support of vaping, in response to a publication by the French High Council for Public Health last year which was critical of the sector. Everything must be done to find effective ways to reduce smoking rates. A tried and tested means would be the e-cigarette: “According to the highly recognized international scientific consortium Cochrane, the most effective of these means of nicotine substitution are electronic cigarettes…“. Pointing to the high relapse rates among smokers seeking to quit with medical cessation devices—an estimated 70 percent to 80 percent of users return to smoking—the authors call on healthcare professionals to recommend e-cigarettes to smoking patients as a significantly less harmful alternative.”

ILLINOIS [Bill 3854 Flavor Ban]

“State Sen. Julie Morrison, D-Lake Forest, has been a steadfast supporter of banning flavored tobacco products. She has introduced Senate Bill 3854, which would prohibit the sale of all flavored tobacco products, including cigarettes, e-cigarettes and chewing tobacco. The measure remains in a Senate committee. Municipalities around the state, including Chicago, Skokie and Oak Park, have all passed some kind of ban on the sale of flavored e-cigarette and vaping products.

Elizabeth Hicks, U.S. Affairs analyst with the Consumer Choice Center, said enacting a flavor ban for vaping products will push adult consumers to switch back to smoking combustible tobacco at a time when smoking cigarettes has been trending down in Illinois. “About 12% of adults in 2020 reported smoking, however, if this bill passes, we can certainly expect that number to increase,” Hicks said.

BIG TOBACCO SUPPORT FOR ANTI-VAPING AGENDAS

“Under increasing pressure, big tobacco companies are doing everything possible to keep electronic cigarettes, which offer a safer nicotine alternative, from intruding upon their shelf space. It is easy to see why vaping, which offers a safer product with reportedly better taste and smell due to its wider availability of flavors, is edging out traditional cigarettes in the marketplace. But tobacco companies aren’t competing in a free market. And Big Tobacco learned long ago how to use their financial clout to make sure the regulatory process works in their favor. They’ve developed a deep political playbook at the federal and state level as well. At the federal level, tobacco companies are promoting federal taxes on electronic cigarettes and even tax cuts on traditional cigarettes. At the state level, there are campaigns to ban flavored electronic cigarettes and to divert some Master Settlement Agreement funds from anti-tobacco advertising to anti-vaping advertising. ”
