VAPING NEWS: COLORADO [Vape Tax]
“After weeks of back-room negotiations with health care advocates and a tobacco producer, Colorado lawmakers introduced a measure Thursday to put a tobacco and vaping tax measure on the November ballot. The bill comes two days before the session was scheduled to conclude. If it clears its first hurdles, lawmakers will need to meet Saturday for a final vote. It would also create a tax on nicotine products such as on vape products that would be equal to 50% of the manufacturer’s listed price until July 1, 2024, 56% until July 1, 2027, and 62% after, the same tax on tobacco products.”

VAPING NEWS: BETHLEHEM, NEW YORK [Vape Shop Licensing]
“The Bethlehem town board is set to vote on imposing strict new regulations on the sale of tobacco and vaping products that would require retailers to get a local license. The new regulations would be accompanied by a six-month ban on the approval of any new vaping shops as the town sets up the licensing program. The licensing program would be designed as a “cap and winnow” system that would require two businesses to give up their tobacco licenses if a new retailer wanted to get a license. “We’ll vote on these proposed local laws at our June 24th town board meeting,” Bethlehem Supervisor David VanLuven said Wednesday night after the second Zoom public hearing call.”

FROM REGULATOR WATCH – Vesting Clause | Vaping V. The Power of The Administrative State | RegWatch (Live)
Here’s the latest from Brent Stafford at Regulator Watch:
The fight to save vaping has always been a David versus Goliath struggle. Facing countless regulatory hurdles, the U.S. vaping industry mostly comes up short when seeking relief from the courts for what it believes to be arbitrary and capricious rulemaking by the U.S. Food and Drug Administration.
With FDA poised (yet again) to deliver a death blow to the U.S. vaping industry via its Pre-market Tobacco Application process, a lawsuit championed by Big Time Vapes Inc. and the United States Vaping Association Inc. could stave off disaster if the plaintiffs successfully argue, before the Fifth Circuit Court of Appeals, that Congress ceded too much authority to the executive branch when it passed the Tobacco Control Act of 2009. An authority used by the FDA to deem vaping products subject to FDA regulation. In this episode of RegWatch we are joined by USVA’s lawyer Jerad Najvar to discuss the intricacies of the case, including whether the “deeming” authority is so extreme that it’s unconstitutional, and if Congress failed in its duty when it delegated power to legislate to the FDA with little guidance and no restraint.

Hey! I know this guy! Thanks for having me on Brent and allowing me to vent a bit.
Here’s the latest from Brent Stafford at Regulator Watch:
Over the years the anti-vaping movement honed the tactics of creating mayhem and misery for those who rely on vaping as a tool for harm reduction.
For vapers, wading through lies and half-truths has long been the daily norm. Yet the mendacity seems to be getting worse, as ideologues in the war on vaping capitalize on recent health scares to plot new attacks intended to stamp-out vaping for good.In this episode of RegWatch we are joined by Phil Busardo, celebrated YouTube show co-host and prolific vape reviewer. Hear Busardo share his aggravation over the mind-bending hypocrisy of the anti-vaping movement and learn what he thinks could be a winning strategy for vaping.
