“Arizona’s attorney general has obtained an injunction against a New Jersey-based vaping company he recently sued that bars the company from marketing or selling any of its products in the state. The injunction against Eonsmoke was announced by Attorney General Mark Brnovich on Thursday. The preliminary injunction issued by a judge in Phoenix bars Eonsmoke from marketing or selling its products in Arizona. It also requires the company to contact retailers, tell them to stop selling any of the company’s products and orders Eonsmoke to remove all its vaping cartridges up for sale in the state.”

Injunction halts sale of Eonsmoke vape products in Arizona

“The Canadian Constitution Foundation has released an executive statement from a report looking at possible avenues for a constitutional challenge to current and proposed vaping legislation in Canada by Dr Leonid Sirota, professor of law at the Auckland University of Technology Law School. The Foundation says that the “conflation of vaping and smoking within the law runs contrary to the best available evidence and risks conveying to smokers the impression that vaping is not meaningfully different and better than smoking, discouraging them from trying what may be the best harm-reduction method available.” It states the report analyses various constitutional concerns about the regulation of vaping, both in terms of the laws falling outside of federal jurisdiction as well as running afoul of the Charter of Rights and Freedoms.”

“The Town of Quispamsis is preparing to ban smoking on municipal property. Starting April 1, all smoking and vaping will be banned from any grounds owned by the town. That means no smoking on roads or sidewalks, or outside town-owned facilities. There are no plans for designated smoking areas in Quispamsis. Violators could be given a $125 ticket by Bylaw enforcement officers or the Kennebecasis Regional Police Force.”

Quispamsis to ban smoking on municipal property

“Governor Andrew Cuomo is once again pressing for a ban on flavored tobacco-based vaping products, saying he hopes a law is passed in the next month. Cuomo and his health commissioner, Dr. Howard Zucker, tried to ban the products in New York last fall, but the emergency order by a state panel was stopped in court, after the vaping industry sued. Now Cuomo has proposed a ban, along with comprehensive regulations, in his budget plan. The measure would end the sale of all flavored electronic cigarettes, including menthol, and discontinue all advertisements, including social media ads that Cuomo says are targeted toward teens. The bill also bans the sale of vaping products at stores that include pharmacies, as well as online sales.”

Cuomo Once Again Presses For Flavored Vaping Ban

“The House will vote next week on a bill aimed at reducing youth vaping rates by banning the sale of flavored tobacco products, including e-cigarettes. The bill, sponsored by House Energy and Commerce Chairman Frank Pallone (D-N.J.) and Rep. Donna Shalala (D-Fla.), would also ban online sales of e-cigarettes and tobacco products. The Pallone-Shalala bill would ban flavors in all of these products. It includes a narrow pathway for the Food and Drug Administration (FDA) to approved flavored products if they are found to reduce smoking rates. Opponents of e-cigarette flavor bans argue those products are useful for adults to transition away from traditional cigarettes. After May, companies that want to sell e-cigarettes in the U.S. will have to receive approval from the FDA and prove their products benefit public health.”

House votes next week on flavored e-cigarettes ban

“The long-standing dispute over new smokeless tobacco products is set to return to the Riigikogu on Thursday next. The Riigikogu Social Affairs Committee recommends allowing such products as well as menthol-flavored e-cigarettes. New heated tobacco products appeared a few years ago, and while they still do not have a proper name in Estonian, user figures are swelling. Allowing smokeless tobacco products has been discussed in the parliament for over a year, with the final decision expected next Thursday. That is when the bill initially meant to regulate the tobacco products’ monitoring system will come up for its second reading. The bill set to reach the floor on Thursday would soften another aspect of tobacco policy. Tõnis Mölder said that in addition to new tobacco products, flavored e-cigarette liquids also cross the border with people. The committee has decided to allow menthol-flavored e-liquids to be sold once again.”

Social affairs committee would allow new tobacco products to market

“Mexico has announced it will ban the import of electronic cigarettes by presidential decree starting Thursday. The commerce of electronic cigarettes in the country was banned in 2008, however the “regulatory framework” necessary to prevent the trade of the devices on the black market would be satisfied by the new decree. The ministry cited the World Health Organization (WHO) as saying that vaping devices are harmful and represent a threat to the general population.”

Mexico Bans Import Of Electronic Cigarettes

“Duke University, a college campus with deep roots in tobacco money, is set to go smoke-free this summer, but it’s more than tobacco products that will be banned. Administrators announced in an email to students earlier this month that e-cigarettes and vaping products will be included in the ban, too. The smoke and vape-free policy, scheduled to take effect on July 1, has been two years in the making. It will apply to all property and facilities owned or rented by Duke.”

Research and experience show that when cigarettes and other products are heavily taxed, the consequences mimic America’s failed experiment with alcohol Prohibition. Legislators in five northeastern states — New York, New Jersey, Rhode Island, Vermont and Maryland — have introduced bills to ban flavored cigarettes and vaping products in some fashion. Consumers also may be getting the products they want from different counties, states, Indian reservations or international sources. Some may even use “do it yourself” with menthol-flavored oils or through homemade vaping devices and e-liquids. Consumers do not need a nanny, and they won’t passively accept a ban. Some people like flavored cigarettes, and other flavored nicotine products, and many are willing to obtain them by crossing a border or buying online. States everywhere need to inform themselves about the data. High taxes and outright bans will lead to large-scale smuggling and other lawlessness.”

Flavor prohibitions will leave bad taste in states’ mouths

“In the midst of passing a regulation on new taxation on tobacco and tobacco related products,  Croatian Vaping association CROHM has managed to stop the process of taxation on e-liquids in Croatia. On Januray 24th 2020., a new tax Proposal from the Ministry of finance was in procedure of public consultation with an aim to introduce tax on all e-liquids, regardless of nicotine level, in amount of 1HRK/ml (0,13€/ml).”
