VAPING NEWS: CONSEQUENCES OF FLAVOR BANS

“A lot of these actions are hinging on the so-called “epidemic” the FDA has highlighted over teen e-cig use, as well as the lung illness outbreak last year that resulted in dozens of deaths and thousands of injuries. The problem is that adult usage is getting swept up in the hysteria over teen use, and the health issues were almost entirely related to illicit vape products mostly bought on the internet. Policymakers are now willing to ban commercially tested products — and that will lead to the purchase of more black market products. It will also crush the movement away from cigarettes. If other states follow California’s or Massachusetts’ lead, the opportunity to wean smokers off of cigarettes will be greatly diminished.”

VAPING NEWS: FLORIDA [Public Parks Ban]

“A Senate committee Monday approved a proposal that seeks to let local governments decide if they want to ban smoking at their public parks. The state, rather than local governments, generally controls tobacco-related laws and regulations. Under constitutional amendments passed in 2002 and 2018, smoking tobacco and vaping are banned in enclosed indoor workplaces throughout the state. The 2018 amendment also allows local governments to adopt more-restrictive ordinances on vaping, which could include banning the use of electronic cigarettes in public parks. A House version of Debbie Mayfield, R-Rockledge, bill (HB 457) has not been heard in committees.”

VAPING NEWS: U.S. C-STORES [Product Ban Guidance]

“With the flavored vapor cartridge ban looming, NACS reminded convenience store retailers need to remove all cartridge-based electronic cigarette flavors, except menthol and tobacco, from the backbar by Feb. 6. The Food and Drug Administration (FDA) issued its new policy on unauthorized flavored cartridges and pod-based e-cigarettes and vapor products in early January. The new policy does not include e-liquids and disposable vapor products. According to NACS, the agency’s guidance only states that retailers cannot sell the products as of Feb. 6, and does not ban the possession of the products in stores. However, the association advises retailers to take steps to remove the banned products from their stores as soon as possible to prevent any inadvertent sales.”

VAPING NEWS: ONTARIO, CANADA [C-Store Flavour Ban]

“The Ontario government is moving to ban most flavoured vaping products from convenience stores and gas stations and cap nicotine levels. Health Minister Christine Elliott will present proposed regulatory changes to provincial cabinet members in the coming days. The new rules won’t apply to specialty adult-only vape shops, which require proof of age to make a purchase, and sell only vaping products. Those stores will still be able to sell a variety of flavoured products and e-cigarettes with higher nicotine content.”

VAPING NEWS: BARRINGTON, RHODE ISLAND [Tobacco 21]

“The town of Barrington, Rhode Island, lacked the authority to enact an ordinance prohibiting the sale of cigarettes and other tobacco products to people under the age of 21 because the regulation of tobacco is a “matter of statewide concern,” the state’s Supreme Court ruled.”

“The authors say their findings suggest that today’s smokers who want to quit are using e-cigarettes as an aid whereas in the past quitters had to rely on other smoking cessation aids. And it appears that smokers find e-cigarettes a useful and effective quitting aid, as current users of e-cigarettes are more likely to be recent quitters than non-users, and some successful quitters then stop using e-cigarettes.”

VAPING NEWS: NEW YORK [Flavor Ban]

“Attorney General Letitia James late Friday appealed a judge’s order that struck down New York’s emergency ban on flavored e-cigarettes. James asked the appeals court to overturn the ruling by acting state Supreme Court Justice Catherine Cholakis, who in part said that Gov. Andrew Cuomo and health officials exceeded their authority in approving the temporary ban last fall. It is the second time the appeals court in Albany has been asked to intervene in the case. In October, it temporarily halted enforcement of the ban just hours before it was to take effect. Meanwhile, state lawmakers are debating various legislation that would permanently ban flavors in vaping and tobacco products. Unlike the embattled emergency ban, the measures would include the prohibition of menthol flavors”

VAPING NEWS: IRISH CANCER SOCIETY [Marketing & Flavour Ban]

“The Irish Cancer Society (ICS) says it wants politicians to protect children from “the tobacco and alcohol industries” as the parties gear up for the 2020 election hustings. The ICS is “concerned that e-cigarettes are being used to by tobacco companies to target children to be the next generation of nicotine addicts in Ireland.” Ignoring all of the evidence from this [UK] side of the Irish Sea, the ICS foolishly shouts: “We want a ban on e-cigarette flavours and on advertising of e-cigarettes.””

VAPING NEWS: IMPERIAL BRANDS [Big Tobacco Vape Products]

“Cigarette maker Imperial Brands Plc named Stefan Bomhard, CEO of car dealer Inchcape, as its new chief executive on Monday to steer the company through challenges in e-cigarettes and vaping and falling consumption of tobacco products. He faces the task of turning around Imperial’s vaping and other ‘next generation’ products, which were meant to be the future for Imperial Brands but growth has been slower than expected. Imperial makes 30% of its profits in the United States. Bomhard will also be seeking to boost sales of Imperial’s flagship blu e-cigarette brands, which Cooper admitted were not attracting consumer loyalty despite Imperial’s marketing efforts.”

BILL TARLING – The move from being a car dealer to Big Tobacco CEO also comes with a healthy pay rise for Bomhard, who made a £739,000 base salary at Inchcape. His new wage packet will be almost £1.3m, with a potential bonus of up to 200 per cent of his salary, plus incentive pay.
