“Lame duck City Council member Michael Nowakowski has decided that one of his last moves in office is to try and ban flavored tobacco products, including everything from vapes to wintergreen dip and menthol cigarettes. Assuming he’s doing this to combat illegal underage vaping, the intent of his proposal is admirable, but the approach is dangerously misguided. A prohibition on these adult products is shortsighted and has the potential to do irreversible economic harm that affects more than me, but also my employees and their families. If the Phoenix City Council votes to implement a flavored tobacco ban, it will only further decimate small, locally owned businesses that have struggled to stay afloat in recent months.”

VAPING NEWS: SIXTH CIRCUITS RULES AGAINST SHOPS E-CIG CHALLENGE OF FDA DEADLINE
“A Kentucky-based e-cigarette retailer lacks standing to challenge an FDA deadline for regulatory filings on vapor and nicotine products because the deadline was issued by a federal judge, not the government, the Sixth Circuit held Monday. U.S. District Judge Karen Caldwell, an appointee of George W. Bush, sided with the government and ruled that Vapor Stockroom could not sue the FDA because any injury caused by the accelerated deadline was the result of action by the federal judge in Maryland. A three-judge panel of the Sixth Circuit agreed with Caldwell in a brief, 11-page per curiam opinion on Monday. “The Maryland court’s injunction was not an action by the FDA – it was an action taken by the court itself,” the ruling states.”

“Backers of Measure 108 hope broad, bipartisan support and a well-funded campaign will push the effort to increase taxes on cigarettes and create a tax on vapes to victory in November. A “yes” vote establishes a tax on nicotine inhalant delivery systems, such as e-cigarettes and vaping products which are not currently taxed. The funds from the tax increase would be used for public health programs including smoking prevention and cessation programs. BILL TARLING –– So the Oregon Gov’t intent is to con the public into voting support for penalizing the most successful product used in creating ex-smokers with an additional tax in order to supposedly use that cash grab revenue towards getting people to stop smoking [which is what the vape products were already accomplishing]

VAPING NEWS: CALIFORNIA [Governor Signed SB 793 Flavor Ban]
“The Legislature passed and Governor Newsom signed SB 793 by Senator Jerry Hill (D-San Mateo) on August 28 as Chapter 34. The bill, which banned flavored tobacco, added Article 5 (commencing with Section 104559.5) to Chapter 1 of Part 3 of Division 103 of the Health and Safety Code. Section 1 of the bill added Article 5, which is titled, “Tobacco Sale Prohibition.””

“The Consumer Choice Center (CCC) has published an index ranking each U.S. state on the consumer-friendliness of its vapor regulations. Rankings are assigned based on a legislative actions, including restrictions, taxation, and online sales prohibitions. According to the index, California is the “worst state for vaping.” New York, California, New Jersey, Massachusetts and Rhode Island are also among the least consumer-friendly states. Excessive flavor bans, taxes, and prohibitions on online commerce grow the black-market sector and harm consumers who want less harmful alternatives to smoking. If states want to innovate in 2020 and provide adult smokers with an alternative that is less harmful, they should look to reform their state laws to better accommodate this new technology that is helping millions.”
NOTE: Colorado will likely plummet in the near future, as they have heavy vape product taxation on the election ballot under Proposition EE, and are also pushing for complete flavor bans. In fact, under their proposed regulations, cigarettes would be taxed at a lower rate than vape products, and they admitted they are intentionally taxing the vape products in order to cover their budget shortfalls which they mismanaged.

Stoptober is back: The UK’s annual challenge to quit smoking in the month of October. According to the NHS if a smoker can stay quit for 28-days then it is 5 times more likely the person quits for good.
Those are great odds. But what about how a smoker chooses to quit, does that improve the odds of success?For years UK government health organizations have been leading voices in support of vaping as a tool for tobacco harm reduction. Yet the UK is not immune to the massive worldwide campaign of misinformation intended to discredit and destroy vaping as a viable alternative to smoking.
In this episode of RegWatch we are joined by tobacco harm reduction advocate and clinical consultant Louise Ross to discuss realities on the ground in the UK effort to stamp out smoking.
