VAPING NEWS: CONCORD, CALIFORNIA [Potential Lawsuits And/Or Eviction If You Vape On Your Private Balcony]

“Come 2021 the residents of Concord, California, have something exciting to look forward to: not being allowed to vape on their own balconies. On January 1, the small Bay Area city’s ban on smoking in multi-unit properties takes effect. Once it does, anyone living on a property with two or more units—which would include apartment buildings, duplexes, mobile home parks, and residential care facilities—won’t be allowed to smoke or vape inside their residence. Stepping out onto the porch isn’t an option either, as the new policy prohibits smoking in “exclusive-use unenclosed areas” like decks and balconies. Apartment dwellers who violate that lease condition could be subject to civil lawsuits from their landlord or any of their neighbors. San Francisco explicitly barred tenants from being evicted if they violated the city’s smoking ban. Concord’s policy has no such provision.”

Never carry loose 18650 batteries in your pocket because the probability that the batteries will touch other metals objects such as keys, coins or other batteries is too high. A lithium-ion battery can react violently in the event of a short circuit, and a short circuit can happen if a metal object touches the battery’s positive pole – and any other metal part of the battery – simultaneously. Even a sudden discharge of static electricity – which can happen, for example, if you’re wearing synthetic pants – can be a dangerous situation if you’re carrying a lithium-ion battery in your pocket. The only safe way to transport an 18650 battery is in a hard carrier that protects the battery and prevents it from touching other metal objects.”

FROM REGULATOR WATCH – Great Vaping Reset | Canada Moves to Restrict Nicotine Levels

Here’s the latest from Brent Stafford at Regulator Watch:

Another hammer has dropped on the Canadian vaping industry. The Federal government announced it is moving to restrict nicotine levels to a maximum concentration of 20mg/mL for vaping products manufactured, imported, or packaged for sale in Canada.
For many Canadian vapers, the proposed new limit would slash (by half for some) the amount of nicotine consumed when vaping and (by Health Canada’s own projections) cause some vapers to return to smoking.

In this episode of RegWatch Darryl Tempest, executive director and lead advocate from the Canadian Vaping Association discusses the impact of the proposed nicotine cap and provides a roundup of the fight against flavour bans and vape taxes sprouting up in provinces across the country.

VAPING NEWS: CALIFORNIA [Flavor Ban Enforcement Delayed To Give Time To Verify Petition Votes]

“California state officials have agreed to delay the effective date of what state lawmakers intended as a Jan. 1 ban on flavored tobacco products, after opponents led by tobacco companies said they filed enough signatures to put the new law to a statewide vote. The secretary of state and attorney general’s offices won’t enforce the pending law until county clerks have enough time to verify that there are at least 623,000 valid signatures. Inyo County’s top elections official, Kammi Foote, this week said she was referring the petition there to the county district attorney because her office found a high level of signatures that do not match county records. What supporters called one of the nation’s strongest such laws would not make it a crime for people to possess flavored tobacco products, but bans retailers from selling them.”

VAPING NEWS: CONGRESS KEEPING TOBACCO TAX REVENUE FLOWING BY DESTROYING VAPING USING FAKE CHILDREN PRETEXT

“Buried in the enormous spending/COVID-19 relief package that Congress approved this week is a bill that imposes new restrictions on the distribution of all vaping equipment, parts, and supplies, including a ban on mailing them. The provision illustrates not only how utterly irrelevant legislation can be slipped into unread, must-pass bills but also how Congress warps reality through legal fictions and uses save-the-children rhetoric to justify restricting adults’ choices. Title VI of the 2021 Consolidated Appropriations Act, which appears on page 5,136 of the 5,593-page bill. The Feinstein bill further expands the Jenkins Act, redefining cigarette to include “electronic nicotine delivery systems,” which are not cigarettes. It also counterintuitively defines electronic nicotine delivery system to include products that do not deliver nicotine: “any electronic device that, through an aerosolized solution, delivers nicotine, flavor, or any other substance to the user inhaling from the device” (emphasis added). That category includes e-cigarettes, e-hookahs, e-cigars, electronic pipes, vape pens, and refillable vaporizers, plus “any component, liquid, part, or accessory” used with those devices, whether shipped together with them or sold separately. In other words, every product related to vaping, whether of nicotine, THC, CBD, lavender, or anything else, will now be subject to the Jenkins Act’s burdensome requirements.”

VAPING NEWS: ONLINE VAPE SALES ID & AGE VERIFICATION

“President expected to sign the legislation that requires adult age verification upon delivery of e-cigarettes, matching other tobacco ID rules passed a decade ago. Congress has passed legislation in the end-of-year omnibus spending packages to stop the online sales of e-cigarettes to minors. The legislation closes the online loophole for e-cigarettes that exists by requiring that the age of the recipient be verified in-person at delivery. The Preventing Online Sales of E-Cigarettes to Children Act was introduced in the U.S. Senate by Sens. Dianne Feinstein, D-Calif., and John Cornyn, R-Texas, and in the U.S. House by Reps. Rosa DeLauro, D-Conn., and Kelly Armstrong, R-N.D. The legislation requires online sellers of e-cigarettes to ensure that the delivery carrier verifies the age of the recipient upon delivery. It also requires online sellers to collect and remit the appropriate state and local taxes.”

VAPING NEWS: CALIFORNIA [Tobacco Referendum Petition Investigation]

“Elections officials in Inyo County said Monday that at least 70% of the signatures submitted to block a California law banning the sale of flavored tobacco are invalid, with dozens of voters saying they never signed the petition. Last month, a campaign funded by the nation’s largest tobacco companies announced it had gathered more than 1 million voter signatures to qualify a referendum on the new law for the November 2022 statewide election. The law, Senate Bill 793, outlaws the retail sale of flavored tobacco products in California and is scheduled to take effect on Jan. 1. But if elections officials determine at least 623,212 valid voter signatures have been gathered, the enactment of SB 793 will be on hold for at least the next two years. Under California law, voters can overturn a statute signed by the governor through a referendum — having done so most recently last month, when they rejected Proposition 25 and the plan to eliminate cash bail in the state. Forging a signature on a ballot measure petition and submitting the document to elections officials are misdemeanors under state law, punishable by jail time and a fine of up to $5,000.”

NOTE: The coalition has received more than $21 million so far, largely from companies including Philip Morris USA and its affiliated U.S. Smokeless Tobacco Co., as well as R.J. Reynolds Tobacco Co. Opponents needed to collect the signatures of 623,312 registered voters to quality the referendum.

VAPING NEWS: VAPE PRODUCT SHIPMENTS BANNED FROM USING U.S. POSTAL SERVICES

“The Covid-19 relief bill passed by the U.S. Congress on Dec. 21 prohibits the U.S. Postal Service from delivering packages containing e-cigarettes. It also subjects e-cigarettes to other rules that currently govern online cigarette sales. Among other things, online retailers will be required to use private shipping services that collect an adult signature at the point of delivery, collect all applicable local and state taxes, and send each taxing state’s tax administrator a list of all transactions with customers in their state. The new rules could go into effect as soon as 120 days. “If the increase in shipping costs wasn’t enough, the bill also imposes huge paperwork burdens on small retailers, and backs it up with threats of imprisonment for even innocent mistakes,” American Vaping Association President Gregory Conley said in a statement. “This is not a law designed to regulate the mail-order sale of vaping products to adults; it’s an attempt to eliminate it.” “
