VAPING NEWS: NEW ZEALAND [Flavor Restrictions + Public Ban]

“Sales of vaping products to under-18s will be banned, flavours restricted and vapers barred from lighting up in smoke-free areas under a law change set to be introduced to Parliament on Monday. Vaping laws will be bought closer to tobacco laws under the proposed law change, including a prohibition on advertising and sponsorship of vaping products and e-cigarettes. But the Government has ruled out a complete ban because it sees vaping as one way to help smokers quit more harmful cigarettes.”

“As the bill is currently written, no vaping products will be able to be sold to people under the age of 18, nor are the products able to be advertised or used in sponsorship. Vaping will also be banned from smokefree areas, so people would only be able to vape where cigarettes are allowed to be smoked. Salesa said the bill will also limit general stores – including dairies and service stations – to selling only three flavours: tobacco, mint and menthol. All other flavours will only be able to be sold at licensed vape stores.”

VAPING NEWS: NEW YORK [Cuomo’s Anti-Vaping Assault]

“On Thursday, Gov. Andrew Cuomo announced a package of initiatives he supports to combat youth tobacco use, including a ban, contained in his proposed executive budget, on the sale of all flavored vaping products in the state, including menthol flavors. The goal is put the laws on the books after efforts to enact bans via executive order have been rejected by the courts in recent months.”

BILL TARLING – Cuomo wants e-liquid products banned, but has encouraged marijuana availability. Even his anti-vaping petition is strictly one-sided (you can only vote in favor of the ban). New York generates over a Billion Dollars a year in tobacco tax revenue as long as New Yorkers keep smoking. A ban on e-liquid vape products will help protect his State’s smokers revenue stream.

VAPING NEWS: CDC SCARE CLAIMS DAMAGED UNRELATED E-LIQUID VAPING INDUSTRY

“New research suggests that last summer’s spate of severe lung illnesses tied to vaping prompted many Americans to consider giving up e-cigarettes. Online searches about how to quit vaping spiked after serious lung injuries among vapers started being reported, the study authors found. Before these lung illness cases were connected primarily with vaping of marijuana and additives, many people who used nicotine-containing e-cigarettes were concerned, the researchers noted.”

VAPING NEWS: ARIZONA [Out Of State Sales]

“Arizona’s attorney general has obtained an injunction against a New Jersey-based vaping company he recently sued that bars the company from marketing or selling any of its products in the state. The injunction against Eonsmoke was announced by Attorney General Mark Brnovich on Thursday. The preliminary injunction issued by a judge in Phoenix bars Eonsmoke from marketing or selling its products in Arizona. It also requires the company to contact retailers, tell them to stop selling any of the company’s products and orders Eonsmoke to remove all its vaping cartridges up for sale in the state.”

VAPING NEWS: CANADIAN CONSTITUTION FOUNDATION

“The Canadian Constitution Foundation has released an executive statement from a report looking at possible avenues for a constitutional challenge to current and proposed vaping legislation in Canada by Dr Leonid Sirota, professor of law at the Auckland University of Technology Law School. The Foundation says that the “conflation of vaping and smoking within the law runs contrary to the best available evidence and risks conveying to smokers the impression that vaping is not meaningfully different and better than smoking, discouraging them from trying what may be the best harm-reduction method available.” It states the report analyses various constitutional concerns about the regulation of vaping, both in terms of the laws falling outside of federal jurisdiction as well as running afoul of the Charter of Rights and Freedoms.”

VAPING NEWS: QUISPAMSIS, NEW BRUNSWICK, CANADA [Public Ban]

“The Town of Quispamsis is preparing to ban smoking on municipal property. Starting April 1, all smoking and vaping will be banned from any grounds owned by the town. That means no smoking on roads or sidewalks, or outside town-owned facilities. There are no plans for designated smoking areas in Quispamsis. Violators could be given a $125 ticket by Bylaw enforcement officers or the Kennebecasis Regional Police Force.”

VAPING NEWS: NEW YORK [Flavor Ban]

“Governor Andrew Cuomo is once again pressing for a ban on flavored tobacco-based vaping products, saying he hopes a law is passed in the next month. Cuomo and his health commissioner, Dr. Howard Zucker, tried to ban the products in New York last fall, but the emergency order by a state panel was stopped in court, after the vaping industry sued. Now Cuomo has proposed a ban, along with comprehensive regulations, in his budget plan. The measure would end the sale of all flavored electronic cigarettes, including menthol, and discontinue all advertisements, including social media ads that Cuomo says are targeted toward teens. The bill also bans the sale of vaping products at stores that include pharmacies, as well as online sales.”

VAPING NEWS: HOUSE VOTE [Online Sales & Flavor Ban]

“The House will vote next week on a bill aimed at reducing youth vaping rates by banning the sale of flavored tobacco products, including e-cigarettes. The bill, sponsored by House Energy and Commerce Chairman Frank Pallone (D-N.J.) and Rep. Donna Shalala (D-Fla.), would also ban online sales of e-cigarettes and tobacco products. The Pallone-Shalala bill would ban flavors in all of these products. It includes a narrow pathway for the Food and Drug Administration (FDA) to approved flavored products if they are found to reduce smoking rates. Opponents of e-cigarette flavor bans argue those products are useful for adults to transition away from traditional cigarettes. After May, companies that want to sell e-cigarettes in the U.S. will have to receive approval from the FDA and prove their products benefit public health.”

VAPING NEWS: MEXICO [Import Ban]

“Mexico has announced it will ban the import of electronic cigarettes by presidential decree starting Thursday. The commerce of electronic cigarettes in the country was banned in 2008, however the “regulatory framework” necessary to prevent the trade of the devices on the black market would be satisfied by the new decree. The ministry cited the World Health Organization (WHO) as saying that vaping devices are harmful and represent a threat to the general population.”
