NOT LETTING UP. VTA’S BOARD MEETS WITH WHITE HOUSE AND FDA AGAIN.

On June 13, 2018, the VTA Board of Directors was out in full force for meetings in Washington, DC and Maryland. Specifically, VTA’s Board held its second meeting with the White House and its second meeting this year with FDA. Both meetings were productive especially because the VTA Board was able to demonstrate the leadership that it has been taking on the core issues confronting our industry and perplexing regulators – particularly in the red-hot area of marketing.
In addition, VTA again made the case for the creation of a new path for vapor products that would not relegate them to the trash heap of history through the antiquated PMTA process. In addition, the VTA Board again laid out the conundrum that the current set of undefined regulations are creating for the vapor industry.
Specifically, VTA discussed the various innovations in devices and e-liquids that the FDA’s current regulatory scheme is blocking and how the current regulation, which both bars and disincentivizes innovation, is directly undermining FDA’s primary mission of promoting safe products. We made it clear that, absent a dramatic change by FDA to accept newer, safer and innovative products into the U.S. market, it is merely a matter of time before another bad incident occurs.
The best part: Once again, VTA left both meetings with its homework, and already is working on responding to the Administration’s requests. Learn more about these meetings and the follow up at Vape & the FDA 3 on June 26.
SO-CAL FLAVOR MEETING
On June 5, 2018, VTA went on the road to Southern California to lay out its plan to save flavors. VTA Board Members Chris Howard (E-Alternative Solutions), Josh Church (Joyetech), and George Cassels-Smith (E-Liquitech), we’re joined by VTA regulatory counsel Eric Heyer, of Thompson Hine LLP, and put together a half a day presentation on the link between marketing and flavor regulations as well as the strategies we are implementing for responding to the flavor Advanced Notice of Proposed Rulemaking.
Mr. Heyer (pictured) laid out the legal and scientific arguments that VTA has been developing as part of the first-ever full scientific review that it is conducting for purposes of responding the ANPRM. He also engaged in a series of questions from the audience regarding the implications of those arguments, strategies to pursue, and what else we might expect from the scientific review.
In addition, Mr. Howard explained how VTA’s efforts to encourage the adoption of VTA’s Marketing Standards was essential to how FDA will continue to evaluate our industry and, in particular, to what extent FDA will feel compelled to restrict flavors.
The meeting, which was attended by many of the largest e-liquid brands in the United States and industry leaders, was incredibly engaging.
FLAVOR ANPRM DELAYED!
On the same day that the flavor ANPRM was published, March 21, VTA’s counsel submitted a request for an extension of time from FDA to respond to the flavor ANPRM. VTA member companies and member associations also made similar requests. Having heard nothing, VTA reminded Commissioner Gottlieb on June 5 via Twitter, that the requests were pending and necessary given that we were reviewing 300+ studies. Thanks for all the retweets and likes! A couple days later, June 7, the FDA granted the request and extended the deadline by an additional 30 days – until July 19, 2018.
That will give us even more time to prepare our response and, more importantly, launch our much-anticipated consumer campaign with CASAA. Stay tuned and get ready for launch!
