“Attorney General Mark Brnovich today announced that the Arizona Attorney General’s Office (AGO) obtained a $22.5 million judgment and a permanent injunction against vaping peddler Eonsmoke, LLC. “Eonsmoke is being held accountable for its unlawful conduct in Arizona, including marketing flavored vaping pods to children,” said Attorney General Mark Brnovich. “If you are an Arizona retailer and have Eonsmoke products on your shelves, they are illegal. This final judgment includes comprehensive injunctive relief, and our office will continue to monitor Eonsmoke’s presence in Arizona and ensure its compliance with all state and federal laws.”

VAPING NEWS: RED BLUFF, CALIFORNIA [Public Park Ban]

“The City Council Tuesday approved an ordinance that, among other things, would ban outdoor smoking and vaping in city parks and unify closing hours for all the parks. Smoking and vaping are now allowed only in enclosed cars at the parks. The ordinance gives the police more tools to eject people from the parks. A violation of park rules, ordinances or any violation of the law could result in a 72-hour ejection from all parks. If there is a second violation within 12 months, it may cause a person to be excluded from all parks for 30 days. The third violation within two years may result in a 90-day exclusion from parks, while the fourth violation in two years could get a person banned from the parks for a year.”

VAPING NEWS: NEW ZEALAND [New Vape Regulations Passed]

“The Smokefree Environments and Regulated Products (Vaping) Amendment Bill introduces a range of regulations that will be phased in over the next two years. From November, prohibitions will be in place on vaping in the workplace, advertising and sponsorships related to vaping products, and the sale of vaping products and toy products to those under 18 years old. The bill also limits generic retailers such as dairies, service stations and supermarkets to selling only tobacco, mint and menthol flavoured vaping products, but specialist vape retailers will be able to sell any flavours from their shops and websites.”

VAPING NEWS: MASSACHUSETTS [Flavor Ban Caused Lost Tax Revenue]

“Massachusetts’ ban on the sale of flavored tobacco products has shifted rather than reduced tobacco consumption, according to Ulrik Boesen, senior policy analyst with the Center for State Tax Policy at the Tax Foundation. At first sight, early data suggests a public health success: sales of cigarette tax stamps in the Bay State have declined 9.2 percent in the first half of 2020 compared to the same months last year. However, sales of tax stamps in the Northeast region have remained stable suggesting Massachusetts consumers are now buying their tobacco products in neighboring states. “In addition, the ban on flavored tobacco highlights the complications of contradictory tax and regulatory policy, the instability of excise taxes that go beyond pricing in the cost of externalities, and the public risks of driving consumers into the black market through excessive taxation or regulation.””

“The public was sold a false bill of goods by “grassroots” anti-vaping activists when they crusaded against e-cigarettes and e-cigarette flavors in front of city councils, state houses and the U.S. Congress throughout 2019. Were flavor bans the right approach to curb teen vaping? A new scientific survey suggests otherwise. Authors of the “Youth Perceptions of Juul in the United States,” found that a paltry 5 percent of respondents said it was the different flavors of the e-cigarettes that brought them to the product. “Flavors are an essential element of encouraging switching to vaping, and we need regulations that focus on a risk-benefit analysis rather than inadvertently perpetuating the cigarette epidemic,” said David Sweanor of the Center for Health Law, Policy and Ethics at the University of Ottawa. The real victims of the anti-flavor crusade are former smokers who use flavored e-cigarettes to stay away from combustible tobacco cigarettes along with current smokers who are looking for an effective way to quit smoking.”

“The IFoA E-cigarettes Working Party was set up to try to answer how the industry should approach pricing and underwriting for e-cigarette users. To understand the risks of e-cigarettes we needed to consider a few key points: How to satisfactorily underwrite to differentiate between types of smokers – smokers, ex-smokers, dual-users, never smokers. Ideally, we need data that is split by the different types of e-cigarette users – most notably dual-use (e-cigarettes alongside tobacco) versus ex-smokers who are using e-cigarettes to help them quit. This becomes a complex problem when we further allow for factors such as ‘proportion of e-cigarette vs tobacco usage’ in dual-users, or ‘period since quitting tobacco use’ for ex-smokers. If we are to potentially charge less for e-cigarette users, it’s essential to be able to accurately identify what types of cigarettes are used. There seems to be a growing consensus among medical experts that the risk will be lower than the risk associated with traditional tobacco use. Some medical experts we have consulted were initially quite wary but have joined the ‘positive camp’ recently.”

“Traditional cigarette sales in the U.S. have continued to do better than those of e-cigarettes during the coronavirus pandemic. Overall sales volume for combustible cigarettes was down 0.2 percent for the four-week period ending July 11 while e-cigarette sales were down 13.2 percent. “It is deeply ironic that the credit for the recovery of the cigarette business from a near-death experience a little over a year ago can be credited to the Centers for Disease Control and Prevention, Michael Bloomberg and the others who pushed an abstinence-only agenda on nicotine,” said David Sweanor. “By undermining the low-risk alternatives to cigarettes, they protected the cigarette business.”
